The Dutch Supreme Court recently ruled that, under certain circumstances, the return on foreign real estate is not included when calculating your actual return for Box 3 tax purposes, based on the June 2024 rulings.
However, under the Box 3 Counter-Evidence Regulation Act (adopted 8 July 2024), the total actual return must be lower than the notional return – and in that calculation, foreign real estate is expected to be included.
More court decisions are likely before the rules become fully clear.
